Trial Case against Former Judicial Officers

The trial against Ramzidah binti Pehin Datu Kesuma Diraja Retired Colonel Hj Abdul Rahman and Hj Nabil Daraina bin Pehin Udana Khatib Dato Paduka Seri Setia Ustaz Hj Awg Badaruddin continued yesterday. Jonathan Caplan QC called witnesses from local banks to formally tender the letters referred to by witnesses from the Anti-Corruption Bureau, ACB and Judiciary Department in relation to the non-existence of Fixed Deposit Accounts, FDA under the First Defendant's name.

Simon Farrell QC objected to the application for a number of reasons, one of which is that it is prejudicial to allow new evidence to be introduced.

In reply, the Prosecution submitted that the witnesses to be called were simply to read out their statements containing information which were already stated in letters from their respective banks.

In delivering his ruling, Justice Lugar- Mawson was satisfied that the Defence has not been taken by surprise as the letters have been referred to throughout the trial.

The Prosecution proceeded to call 7 bank officers from BIBD At- Tamwil Berhad, United Overseas Bank Limited (UOB), Perbadanan Tabung Amanah Islam Brunei (TAIB), RHB Bank Berhad, Malayan Banking Berhad (Maybank), Standard Chartered Bank (SCB) and Baiduri Bank Berhad. These witnesses confirmed that there are no FDAs under the First Defendant's name.

The Prosecution recalled an investigating officer from ACB who was responsible for the investigations into money laundering and possession of unexplained wealth offences against the Defendants.

The ACB officer clarified on the allowances received by the Defendants from the Government. According to the further enquiries made, they have received a total allowance of One Hundred 14 Thousand, 3 Hundred 40 dollars and 92 cents between the two of them over the period from 2002 until 2018. These allowances includes five times passage allowance totalling to 47 Thousand 9 Hundred and 50 dollars. The case will continue again tomorrow.
