He said that the 2017 constitution is different from previous constitutions in that it states that the court's authority to arrest someone for prosecution does not require permission from the parliament. In cases where citizens file lawsuits themselves, whether they are MPs or senators, the court has the authority to issue arrest warrants without having to request permission from the parliament. However, there is a section on coordination that states that there must be no obstruction of parliamentary meetings. Therefore, in the Tak Bai case, if the court issues an arrest warrant, which is normally the court must send to the police for arrest. As for the current open session, it is not relevant. The police have full authority. Therefore, there may be a misunderstanding because the 2017 Constitution clearly states that permission from the House is not required. However, the court will coordinate whether it coincides with the session or not because there is a condition that it must not obstruct the meeting agenda.
